Estate Administration
Administering estates can be a complex process, whether in the UK or internationally. A key part of estate administration is obtaining the grant of probate. This is a legal document issued by the probate registry that gives the executor or administrator the legal right to deal with the deceased person's estate.
To obtain probate in the UK, the executor will need to identify the assets and debts of the estate and submit the relevant inheritance tax forms. Contentious probate
The term "Contentious Probate" refers to disputes that arise in relation to the validity of wills, or claims made against estates. A will may be contested if there are allegations that it is invalid or does not reflect the true wishes of the deceased. Grounds for contesting a will's validity include issues like lack of testamentary capacity, undue influence, or failure to follow required formalities in execution.
Claims may also be brought against an estate by those alleging the deceased owed them money. Common claims include claims by creditors against the estate, or under the Inheritance (Provision for Family and Dependants) Act 1975 by those arguing that reasonable financial provision was not made for them by the will or the intenstacy rules.
Where the will or claim against the estate is contested, it may be necessary to lodge a ‘caveat’, which prevents the Grant being issued until the dispute is resolved. The issues can often be dealt with through mediation and negotiation to avoid going to court. In some cases court proceedings will be needed to determine the validity of the will and or the claim.
